Effect of British Colonization of Pakistan's Legal System: An Under Looked Aspect by Ayesha Majid is a dissertation or thesis written by the author and presented to the public in book format. It takes a hard look at how the colonization of British India impacted Pakistan following the ill-planned and unscrupulous Partition of India in 1947. From this divide three separate, self-governing countries emerged: India, Pakistan, and East Pakistan (later becoming Bangladesh). With a direct case made by Majid on the pre and post-resettlement laws of Pakistan, the author covers virtually every aspect from Common Law to Tax and Tort Laws with the benefit of hindsight and an intellectual examination of the system as a whole.
Effect of British Colonization of Pakistan's Legal System by Ayesha Majid is an insightful and unapologetic view of how colonization has shaped Pakistan. The author writes with authority on a subject most know very little about, and does so as both an academic and an individual with a link to the subject at hand. While it's evident that this manuscript could use polishing by a good editor, it isn't a distraction in the way one might feel it to be in similar books. There are opinions that are peppered throughout the text, but on the whole it's largely impartial. As a reader, I found myself conflicted between a Western mindset of what is "good" and the analysis of the author about what is "right". In truth, very little of what was established was actually good...and even less was right. The facts speak for themselves and facts are not something Majid is short on. I'd highly recommend this piece to anyone interested in history, government and politics, law, and the legal shaping of a nation.
