The Second American Revolution by Glenn Neal is a thought-provoking book that should grab the attention of every eligible voter in America. The author's contention is that the United States Supreme Court has, without any authority, assumed the right to make laws and to amend the Constitution, and that authority can be exercised every time that any five Supreme Court Justices are in agreement. Justices are appointed, not elected by the American people, and thus, they carry no consent from the people to make laws which is, according to the the Constitution, the sole right of Congress.
The author believes that the Justices too often overlook the Constitution and rule according to ideology. Furthermore, the Justices frequently look to foreign law or international law for guidance rather than to what is written in the Constitution. By doing so, the Court has assumed a power that is not rightfully the province of the Court while ignoring the will of the people. Ideally, the Court is restrained by the Constitution, but, in truth, it is not. The author concludes that because of the current power of the Supreme Court, the Constitution has now become what any five Supreme Court Justices say it is.
This is an outstanding book which should be studied and be at the heart of any political discussion. It is a bit academic for some readers, but the summaries are substantial to the understanding of each chapter. The author has researched his points such that the credibility of the contentions of the book are high. For anyone disgruntled with the massive government which appears to be less and less credible to the American people, this is a must-read.
